1. About Us

Welcome to Speak English MOOC Platform!

This Privacy Notice applies to your use of moodle.speakenglish.bartin.edu.tr (the platform). The purpose of this Privacy Notice is to describe how Speak English MOOC Platform collects, uses and shares information about you through our online interfaces (e.g., websites and Speak English MOOC platform). Please review this Privacy Notice carefully. If you do not understand any aspects of our Privacy Notice, please feel free to contact us at speakenglish@bartin.edu.tr 

SpeakEnglish MOOC Platform is a product of a (co-)funded Erasmus+ Strategic Partnership Project in Adult Education coordinated by Bartın University in Turkey in partnership with Universidad Politecnica de Madrid (UPM) from Spain; BEST Institut Für berufsbezogene Weiterbildung und Personaltraining GmbH from Austria; Anadolu University from Turkey. The project is funded by the EU programme between 2019-2021 executed by the Turkish National Agency. 

2. What Information this Privacy Notice Covers

This Privacy Notice covers information we collect from you through our Platform. Some of our platform’s functionality can be used without revealing any Personal Data, but for features or Services related to the Content Offerings, Personal Data is required. In order to access certain features and benefits on our Site, you may need to submit, or we may collect, "Personal Data" (i.e., information that can be used to identify you and which may also be referred to as “personal information”). Amongst others, Personal Data can include information such as your name, email address, city, country, IP address, and device identifier. 

It is your responsibility to provide accurate personal data to Speak English MOOC Platform. Inaccurate information may affect your ability to use the platform and our ability to contact you or the use of the platform services.

3. What You Agree to by Using Speak English MOOC Platform

By registering to our platform, you agree to our use of your personal information because it is necessary for the platform to work as projected and for us to perform our obligations under the contract.

When you register to use our platform, we grant you a limited, personal license to use our services. You may download content from our offerings only for your personal, non-commercial use. Using the services and/or content we offer in the platform does not give you any intellectual property rights for those services and/or content. 

Your registered account will be active for six months on the platform. On the other hand, the content data (i.e. answers for the questions, your audio recordings uploaded to the system) will be kept in our database to be used for dissemination of the results in line with the purposes of this project. Note that your personal information (i.e identity) will be strictly confidential in any presentation or publication made in the scope of dissemination of project results. 

If we rely on your consent for us to use your personal information in a particular way, but you later change your mind, you may withdraw your consent by only deleting your profile from the platform.

4. What Data We Collect

4.1. While Registering 

While you are registering to SpeakEnglishMOOC Platform to create an account to use the content offerings we have, you are asked to provide the following information: 

• Name, surname, email address (required)

• City, country (optional)

When you create your account, and start using the platform you must provide us with accurate and complete information, and you agree to update your information to keep it accurate and complete.

4.2. After you register and start using the platform

After you register and participate in any of the online contents we offer, we and third parties may collect and store the following information:

• comments you make using the discussion forums offered within the contents,

• audios you record as a requirement under certain activities or any other user-generated content submitted by you, such as answers and recordings you submit, peer work, peer feedback, so on and so forth. We also collect data, such as responses to in-video and in-audio questions, standalone questions, and surveys. Except during the registration, do not include any Personal Data or other information of a personal or sensitive nature, whether relating to you or another person. In case you do, we cannot be held responsible for the results of such actions. 

• Email correspondences with Speak English MOOC team to get support or ask anything related to the contents we offer. 

• Responses you voluntarily provide to us in questionnaires or surveys that you participate in related to the platform and the contents offered in the platform.

5. How We Use the Data 

We understand that you trust us with your personal information and we are committed to ensuring you can manage the privacy and security of your personal information yourself. With respect to the information relating to you that ends up in our possession, and recognising that it is your choice to provide us with your personally identifiable information, we commit to giving you the ability to do all of the following:

Data Verification:

• You can verify the details you have submitted to the platform by contacting our team.  Our security procedures mean that we may request proof of identity before we reveal data, including your e-mail address and possibly your address.

Data Use:

• We use Personal Data which you provide to us in order to allow you to access and use the platform, to verify your identity and authenticate your submissions and in order to provide any information, or Services that you request from us

• We use data  relating to your use of the platform to build higher quality, more useful Services by performing analyses of the characteristics and behavior of our users. We may also use this information to ensure the security of our Services and the platform.

• We reserve the right to reuse your submissions and activity responses without using personally identifiable information to share the results from the project as well as to extend its impact and improve the sustainability of the project in line with the purposes of the EU.  

• When you contact us, we may use the Personal data provided by you to provide technical support to you, where required, to ensure the security of our Services and the platform, to respond to your communication and/or as described in this Privacy Notice. We may also archive this information for reporting towards the funding body of the project and/or use it for future communications with you where we are legally entitled to do so. 

We may also use content data in the units (including activity or quiz submissions, answers, and voice recordings), information about your activity on our platform, and demographic data you provided for within the scope of dissemination of project results.

Data Retainment and Share:

• The platform will not disclose any of your Personal Data. Your name will be anonymous but other data you provided such as country, occupation, age etc. may be used within the scope of dissemination of project results to measure the impact of the platform on different participants. 

• You should not post any personally identifiable information or other information of a personal or sensitive nature, whether relating to you or another person, within the platform. If you choose to post personally identifiable information, such personally identifiable information may be collected during your use of the platform. 

• The platform may share your Personal Data to exercise our legal rights or to protect our property; to defend against legal claims; or as otherwise required by law. In such cases, we reserve the right to raise or waive any legal objection or right available to us. We also may share your Personal Data when we believe it is appropriate to investigate, prevent, or take action regarding illegal or suspected illegal activities; to protect and defend the rights, property, or safety of the platform, or our users; and in connection with our Terms of Use and other agreements.

• The platform will not retain your personal information longer than necessary (as long as necessary, especially for reporting purposes towards the funding body of the project). We will hold onto the information you provide either while your account is in existence, or as needed to be able to provide the Services to you, or (in the case of any contact you may have with our team) for as long as is necessary to provide support-related reporting and analysis.

• If legally required or if it is reasonably necessary to meet regulatory requirements, resolve disputes, prevent fraud and abuse, or enforce our Terms and Conditions, we may also retain some of your information for a limited period of time as required, even after you have closed your account or it is no longer needed to provide the Services to you.

• Please note, we are constantly reviewing how we process and protect data. Therefore, changes to our notice may occur at any time. We will endeavour to publicise any changes. 

6. Confidentiality & Security of Personally Identifiable Information

Any standard technical, and administrative security measures will be taken to keep your personal information confidential and secure, and will not be shared with any third parties unless it is necessary to do so based on the applicable law in case of any kinds of threat (i.e. cyberbullying, discriminative language and other sensitive issues) to you or others. 

However, as explained earlier, your content data (i.e. answers to the questions in the exercises in the platform, audio recordings uploaded on the platform) will be available to other registered users only for the purposes of this project to enable peer work and collaboration. 

Please note that 100% security cannot be ensured in the Internet environment, so we cannot guarantee your personal data to be secure 100%. Beware of the risk that an unauthorized third party may find a way to breach our security systems. We would like to remind you that it is your responsibility to protect the security of your personal login data. Please inform us immediately of any compromise or unauthorized use of your account by emailing speakenglish@bartin.edu.tr.

7. Updating or Deleting Personal Data

To update your data on the platform, log in and update the information on your account at any time. If you request to delete data, you can email speakenglish@bartin.edu.tr or contact us on the platform. 

Please note that even if your account is ended, some data may still be visible to others, including any data that has been saved or shared by you or other users. We may retain and disclose some data pursuant to this Privacy Notice for as long as it is necessary for legitimate purposes as given under “Data Retainment and Share” section of this document. 

8. Contents

8.1. Our content

Speak English MOOC offers novel modules and content. While we offer authentic contents, unexpected events may occur. Speak English MOOC reserves the right to cancel or modify any content offerings. 

Completing the course content does not confer any academic credit for participants.  You agree that you will not earn a course certificate or other equivalent documentation of your completion of the Content Offering. 

8.2. Your Content

The services enable you to share your content -such as assignments you submit, recordings you upload and posts you make in the discussion forums or comment sections- with Speak English MOOC and/or other users. You retain all intellectual property rights in, and are responsible for, the user content you create and share. This user content does not include content or materials offered by the developers of the Speak English MOOC. 

When you post content (written, visual or audio) and comments, you authorize Speak English MOOC to use and share this content with anyone, on any platform and in any media.

Legally, by sharing content on our platform, you grant us a worldwide, royalty-free license to use, process, modify, publish and distribute your content for the purposes of this platform. methods.

8.3. Content and Behaviour Rules

We aim to provide universal access to our Speak English MOOC and want to ensure that our users feel safe and comfortable while using our platform. 

Please remember that you are responsible for all the content that you post on our platform. You should keep the posts and other content you upload in line with the following rules and the law, and respect the intellectual property rights of others. 

Beware that certain topics may be sensitive to others. We may remove inappropriate content identified by or reported to us. We may suspend or terminate a user's access to our platform in case of repeated or major offenses. If someone is violating your rights on our platform, please let us know at once.

On the Speak English MOOC platform, you cannot share content that promotes illegal activities, includes threats or violence, harasses or abuses others, fake news, violates intellectual property, privacy, or other rights, and spams other users. 

You also aren't allowed to do anything that violates the law; do anything to put your account at risk share your password or; attempt to access any other account; record, download or share any recordings uploaded to the platform; reproduce, transfer, sell or misuse any content from our services; access or use non-public areas of our systems; breach our authentication or security measures; try to reverse engineer any part of our services; interfere with any user, host, or network, e.g. by overloading or spamming; use our services to distribute malware or for anything other than completing the course; and encourage or help anyone do any of the things aforementioned.

9. International Privacy Practices

Our platform is managed on servers located in Turkey and operated in Spain. In order to provide our services to you, you may be sending your personal data outside of your country. Accordingly, if you reside outside of Turkey or Spain, your personal data may be transferred outside of your country. We are committed to protecting the confidentiality and privacy of personal data when it is transferred.

10. Children

To protect the privacy of children, any access by anyone under the age of 13 is not allowed. Accordingly, we do not deliberately collect or maintain data on our platform from individuals under 13. If you are under 13, then please do not use this platform in any manner. We will take appropriate steps to delete any data from persons under 13 years of age that has been collected on our platform without verified parental consent upon learning of the existence of such data.

11. Dissemination of Project Results

Speak English MOOC aims to improve language learning, and records of your participation in the course may be used for purposes in line with dissemination of project results to a wider community. Your personal identity will remain anonymous in any paper or publication.

12. Disclaimers

YOU ACKNOWLEDGE AND AGREE THAT ANY ACCESS TO OR USE OF THE SERVICES OR SUCH CONTENT IS AT YOUR OWN RISK.

13. Indemnification

You agree to indemnify, defend, and hold harmless the Speak English MOOC Parties from any and all claims, liabilities, expenses, and damages, including reasonable attorneys' fees and costs, made by any third party related to: (a) your use or attempted use of the Services in violation of these Terms; (b) your violation of any law or rights of any third party; or (c) User Content, including without limitation any claim of infringement or misappropriation of intellectual property or other proprietary rights.

14. Governing Law and Venue

The services are managed by Speak English MOOC project coordinating institution, which is located in Bartın, Turkey. You agree that any dispute will be governed by the laws of Turkey.

15. Copyright and Trademark

Speak English MOOC respects the intellectual property rights of our users, and expects our users to do the same when using the services. We reserve the right to suspend, disable, or terminate the accounts of users who repeatedly infringe or are repeatedly charged with infringing the copyrights, trademarks, or other intellectual property rights of others.

Speak English MOOC also respects the trademark rights of others. Accounts with any other content that misleads others or violates another's trademark may be updated, suspended, disabled, or terminated in its sole discretion. If you are concerned that someone may be using your trademark without proper permission on our Services, please email us at speakenglish@bartin.edu.tr, and we will review your submission. If we deem appropriate, we may remove the offending content, warn the individual who posted the content, and/or temporarily or permanently suspend or disable the individual’s account.
